Welcome to Identify Mushroom! These Terms of Service (the "Terms") govern your access to and use of the Identify Mushroom iOS application (the "App"), provided by Efe Budak ("we", "us", or "our").
By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
The Identify Mushroom App is designed to help users identify mushrooms by uploading pictures of them. The App utilizes advanced AI (Firebase Gemini) to analyze the uploaded image and provide information such as the name of the mushroom, its edibility, whether it is poisonous, and its approximate location.
Please note that while we strive for accuracy, mushroom identification can be complex and dangerous. The information provided by the App is for informational purposes only and should not be used as the sole basis for consuming or handling wild mushrooms. Always consult with an expert before consuming any wild mushroom.
The Identify Mushroom App offers subscription-based access to its identification features. Your subscription will automatically renew at the end of each billing period unless cancelled. All payments are processed through Apple's App Store, and are subject to Apple's terms and conditions.
When you use the Identify Mushroom App, you may upload photos of mushrooms for identification purposes. You retain all rights to your photos. These photos are used solely to perform the mushroom identification service via Firebase Gemini. We do not save, store, or otherwise retain any user-uploaded photos after the identification process is complete. No other third parties have access to your uploaded content.
By uploading photos, you confirm that you have the right to do so and that your content does not violate any third-party rights or applicable laws.
We use Firebase Analytics to understand how our App is used and to improve the user experience. Firebase Analytics collects anonymous data about your usage of the App, such as features accessed, session duration, and device information. This data helps us make the App better for you. No personally identifiable information is collected through Firebase Analytics.
The Identify Mushroom App is intended for users who are at least 4 years old. By using the App, you confirm that you meet this age requirement.
The App, its original content, features, and functionality are and will remain the exclusive property of Efe Budak and its licensors. The App is protected by copyright, trademark, and other laws of both Ireland and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Efe Budak.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App. You expressly agree that your use of the App is at your sole risk.
While we strive for accurate mushroom identification, we cannot guarantee the complete accuracy or reliability of the results. DO NOT RELY SOLELY ON THIS APP FOR IDENTIFYING MUSHROOMS FOR CONSUMPTION. Always consult with a qualified expert before ingesting any wild mushroom.
To the full extent permissible by applicable law, Efe Budak disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the App, its servers, or email sent from us are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of the App, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.
You acknowledge that these Terms are concluded between you and Efe Budak only, and not with Apple Inc. ("Apple"). Efe Budak, not Apple, is solely responsible for the Identify Mushroom App and the content thereof. Nothing in these Terms is intended to modify or contradict the Apple Media Services Terms and Conditions (which include the Standard End User License Agreement (EULA) for Licensed Applications) to which you are bound. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
You agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
